A Jurisprudential Perspective on the Abortion Issue

Abstract

The religion of Islam has made some provisions in order to ensure the happiness of people in this world and the hereafter. One thing that Islam wants to be observed is the protection of progeny, and this is only possible with a valid marriage. Therefore, any behavior that would destroy the family institution is prohibited. Islam placed great emphasis on human rights and encouraged marriage, having children, and reproduction, provided that people knew their responsibilities. It prohibited taking a life for any reason. Abortion, which means deliberately terminating a pregnancy, is also prohibited in Islam. The destruction of the fetus in the womb is prohibited, except in cases of necessity, such as when the mother's life is at stake. Islam encouraged proliferation and gave importance to human rights. Although some Islamic jurists have set limits such as 40 days or 120 days for the destruction of the fetus, taking a life is generally considered haram.
