Remedies and Solution Suggestions for the Land Owner in Case of Contractor's Failure to Fulfill His Obligations in Construction Contracts

Abstract

Contract processes in construction projects are important documents that determine the obligations of the parties. However, if the contractor does not comply with the provisions of the contract, the land owner may take legal action to prevent the project from being disrupted and to protect his rights. In this article, the basic legal remedies that the land owner can apply in case the contractor does not fulfill his obligations in construction contracts are discussed. In this regard, relevant articles, books, theses and court decisions in the existing legal literature will be scanned. During the literature review, key concepts such as construction contracts, non-fulfillment of the contractor's obligations, compensation, and breach of contract were focused on. According to the findings, in case of violations of the contractor in construction contracts, the land owner can take legal action such as violation of compliance with the provisions of the contract, notification of default, demand for compensation and termination of the contract. It is important to consult expert lawyers to resolve disputes.
